Family disputes are potentially the most stressful of all and Davies Solicitors aims to make the process as painless as possible for clients.

Collaborative law:

Collaborative Law is a voluntary dispute resolution process originally developed by family law practitioners in the USA. Whilst the divorce process takes a relatively conciliatory approach, the fact remains that any family dispute ending up in Court causes suffering, espescially to children.

The collaborative process stems from an aim to reduce the emotional scars and financial hardships of divorcing couples as much as possible. Collaborative Law is not, of course, for everyone. We are able to discuss with you the various ways in which your matter can be dealt with so that you can decide which method best suits you. Cohabitation Agreements and Prenuptial Agreements:
One way to avoid difficulties in the event of a relationship breakdown is to work together to agree what should happen well in advance. It is a common misconception that living together creates a legal relationship - as there is no such thing in law as a common law spouse. However, cohabitation agreements can assist couples who have little protection under the law.

Prenuptial agreement that are carefully thought out, cover all major areas of family life and follow the principles of family law will likely be given weight in the unfortunate event of a divorce.

Divorce and Dissolution of Civil Partnership:
These issues need to be handled sensitively and, especially when there are children involved. As well as thinking about the immediate future, plans need to be long-term, to avoid situations such as a child having to choose which parent to invite to their wedding.

Children:
Issues relating to children and their welfare include contact, residence, parental responsibility, maintenance, abuduction, the prohibition of moving abroad and specific issues, such as choice of schooling or change of surname.

Often the most contentious of all family issues, the focus must always be on achieving a fair and workable outcome; and wherever possible we seek to achieve a "clean break" where neither party remains dependent on the other for financial assistance.
